What am I Buying?
You are purchasing a Stratum in Freehold Unit Title (Apartment) in Waikareao. For further information please refer to the Pre-Contract Disclosure Statement which will accompany the Sale and Purchase Agreement.

How many units are there?
In total there are 15 Residential Units (Levels 3-5) and a Commercial Unit (Ground and Level 1).

Are there other Conditions?
Yes, the Agreement will also be conditional on the Developer:

1. Being satisfied with the resource consent, building consent and construction costs for the Development
2. Obtaining a minimum 12 apartment pre-sales;
3. Obtaining funding approval from the Developer’s bank.

These conditions will need to be satisfied with 18 months of the Agreement being signed.

Who is the Developer?
159 Elizabeth Limited is the development company. The director is experienced in the construction and development industry.

Can I purchase one or more carparks in the development? Are they covered and are they to be on their own titles?
The Building provides one covered car park per Apartment. A specific carpark will be allocated to each Apartment which will be included on the title to your Apartment.

What has been done to ensure quietness in my new apartment?
An acoustic engineer will be engaged as part of the consenting phase. Certain acoustic levels need to be obtained given the proximity to the Waikareao expressway.

Is there a defects and maintenance period?
Yes, from the date of completion of the building work you will have a 12-month defects and maintenance period within which the Developer will be required to remedy any defects or faults in materials or workmanship.

Am I allowed to have a pet in my Apartment?
Yes, provided they will not create an unnecessary nuisance to other occupiers in the Building.

Am I allowed to make any changes to the layout of the Apartment prior to the commencement of construction? Generally, no. The construction methodology is based on constructing the Apartments in a modular format. This is how the Developer has managed to price them so competitively.

How does the hot water system work?
Each apartment has its own standalone hot water cylinder.

How will the apartment be heated?
Heat pump and ducted system to living areas; bathroom extract fan and kitchen filtered extract hood are included.

What does the Body Corporate do?
The Body Corporate controls the administration and general running of Waikareao residences including ‘common areas’ owned by the Body Corporate members. The Body Corporate is responsible for all general maintenance and upkeep of all facilities. This includes administrating health and safety compliance, obtaining a building warrant of fitness and insurance for the overall building (you will need to take out your own contents insurance). Apartment owners are able to attend Body Corporate meetings and vote on various matters at its Annual General Meeting. There will be a committee made up of elected owners responsible for running the Body Corporate.

The Body Corporate is tasked with ensuring that all costs are reasonably and properly incurred. The Body Corporate works with and alongside the appointed building manager.

Can the price increase from what is agreed?
No, the price is the price unless both the vendor and the purchaser negotiate a variation to such price. The vendor does not have the ability to change the price without agreement in writing from the purchaser.

Does the price include GST? Yes.

How will data be handled in the building?
High speed fibre will be installed.

What appliances do I get with the apartment?

Blinds and curtains are provided.
Internal storage will be limited to the storage as shown on the floor plans – wardrobes in each bedroom, vanity cabinet, kitchen, laundry.

How will waste and recycling be handled?
There will be a rubbish/recycling area on the car park level.

Nevertheless, all information in this document is indicative only, subject to change, and does not form part of the Sale and Purchase Agreement. The Sale and Purchase Agreement forms the entirety of the agreement between the you and the Developer and sets out all details of the property purchased and the legal obligations of both you and the Developer.
